1. Agreement to Terms

By accessing the website located at 4playgolfingsim.com (the “Site”), submitting a booking request, accepting a quote, or participating in any event operated by Fore-Play Golf (“Company,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Site or our services.

2. Services

Fore-Play Golf provides mobile inflatable golf simulator rental services for private parties, corporate events, tournaments, and other occasions in Northern New Jersey and Southern New York State. Services include delivery, setup, operation, and breakdown of simulator equipment at a venue designated by the Client. Additional services such as tent, table, and chair rentals; tournament packages; and custom branding may be available as add-ons. Right- and left-handed clubs are provided at every event.

3. Booking Requests & Quotes

Submitting a booking request through the Site does not constitute a confirmed reservation. All bookings are subject to availability and confirmation by Fore-Play Golf. A booking is considered confirmed only when you receive written confirmation (email) from us and any required deposit has been received.

Quotes provided through the Site or via email are estimates and are valid for thirty (30) days from the date of issuance unless otherwise stated. Final pricing may vary based on event details, travel distance, add-ons, and other factors communicated before confirmation.

4. Deposits & Payment

A deposit may be required to secure your event date. The deposit amount, payment methods, and due date will be communicated in your quote or booking confirmation. The remaining balance is due on or before the date specified in your confirmation. Failure to pay the remaining balance may result in cancellation of your event.

5. Cancellation & Rescheduling

Cancellation and rescheduling policies will be communicated in your quote or booking confirmation. In general:

• Cancellations made 30 or more days before the event date may receive a full deposit refund.
• Cancellations made 15–29 days before the event date may receive a partial deposit refund or credit toward a future date, at our discretion.
• Cancellations made fewer than 15 days before the event date are generally non-refundable.
• We will make reasonable efforts to accommodate rescheduling requests when possible.

Fore-Play Golf reserves the right to cancel or reschedule an event due to unsafe weather conditions, equipment failure, or other circumstances beyond our reasonable control. In such cases, we will offer a full refund or reschedule at no additional cost.

6. Event Rules & Participant Conduct

All event participants must comply with the following rules. The Client is responsible for communicating these rules to their guests.

• Follow all staff instructions and use the simulator and equipment as intended.
• Only one person in the hitting area at a time.
• Appropriate footwear is required. No swinging clubs outside the designated hitting area.
• Participation while visibly intoxicated or impaired is not permitted. We reserve the right to refuse access to anyone who appears under the influence.
• Minors must be supervised by a responsible adult at all times.
• Disorderly, unsafe, or disrespectful behavior may result in removal from the event and early termination without refund.

7. Venue Requirements & Client Responsibilities

The Client is responsible for:

• Providing a clear, level area suitable for the simulator setup — approximately 17'L × 17'W × 11'H (compact unit) or 20'L × 20'W × 13'H (standard unit), indoor or outdoor.
• Ensuring access to standard electrical power outlets within reasonable distance of the setup area, or communicating the need for a generator in advance.
• Obtaining any required venue permissions, permits, or insurance prior to the event.
• Providing safe and legal access to the setup location for our staff and equipment.
• Ensuring participants complete any required waivers or participant forms prior to use.

8. Damage to Equipment

The Client is financially responsible for any damage to Fore-Play Golf equipment caused by misuse, reckless behavior, intentional misconduct, negligence, or failure to follow the event rules by the Client or any event participant. Normal wear and tear during proper use is excluded. The Client agrees to reimburse Fore-Play Golf for the reasonable cost of repair or replacement of damaged equipment.

9. Assumption of Risk

Participation in golf simulator activities involves inherent risks, including but not limited to risk of physical injury from swinging golf clubs, struck golf balls, tripping, falling, or interaction with inflatable enclosures and related equipment. By booking an event and/or participating in any activity, the Client and all participants voluntarily assume all risks associated with participation, whether known or unknown.

10. Limitation of Liability

To the fullest extent permitted by New Jersey law, Fore-Play Golf, its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our services, attendance at any event, or use of the Site.

In no event shall the total aggregate liability of Fore-Play Golf for all claims arising out of or related to a single event exceed the total amount paid by the Client for that event.

Fore-Play Golf is not responsible for injuries, losses, or damages arising from participant misconduct, intoxication, failure to follow rules or staff instructions, pre-existing medical conditions, or conditions at the venue not within our control.

11. Indemnification

The Client agrees to indemnify, defend, and hold harmless Fore-Play Golf, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Client's breach of these Terms; (b) the conduct of the Client or any event participant; (c) any damage to the venue or third-party property caused during the event; or (d) any injury to any person resulting from the Client's or any participant's negligence, misconduct, or failure to comply with the event rules.

12. Participant Waivers

Depending on the event location and venue requirements, participants may be required to sign a participant waiver and release form prior to using the simulator. The Client is responsible for ensuring that all participants complete any required waivers. Our standard waiver is governed by New Jersey law. 13. Certificate of Insurance

Fore-Play Golf can provide a certificate of insurance (COI) for your venue upon request. Please request this at the time of booking so we can accommodate your venue's requirements.

14. Force Majeure

Fore-Play Golf shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, acts of God, government restrictions, pandemic, civil unrest, power outages, road closures, or equipment failure not caused by negligence. In such events, we will work with you to reschedule or provide a refund.

15. Intellectual Property

All content on this Site, including text, images, graphics, logos, and software, is the property of Fore-Play Golf or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written consent.

16. Website Disclaimer

The Site and its content are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of any information on the Site. Pricing, availability, and service details are subject to change without notice.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the services provided by Fore-Play Golf shall be brought exclusively in the state or federal courts located in the State of New Jersey, and you consent to the personal jurisdiction of such courts.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

19. Modifications

Fore-Play Golf reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site or services after changes are posted constitutes acceptance of the revised Terms.
