Important New Jersey Notice: This form is intended to include an adult release for ordinary negligence to the fullest extent permitted by New Jersey law, while preserving claims that cannot lawfully be waived.
In exchange for being allowed to participate in, observe, or be present at any Fore-Play Golf simulator activity, contest, lesson, rental, demonstration, or related use of golf balls, clubs, tees, mats, launch monitors, software, projectors, screens, nets, flooring, power equipment, tents, trailers, or surrounding event space (collectively, the Activities), I agree as follows:
- Assumption of Risk. I understand the Activities involve inherent and other risks, including being struck by balls or clubs, ricochets, slips, trips, falls, uneven surfaces, electrical hazards, equipment malfunction, weather conditions, negligent or unsafe acts of other participants, and errors in judgment by participants or staff. I knowingly and voluntarily assume those risks.
- Adult Release. If I am age 18 or older, then to the fullest extent permitted by New Jersey law, I release and agree not to sue Fore-Play Golf, its owners, members, officers, employees, contractors, agents, affiliates, sponsors, equipment suppliers, landlords, and venue partners for claims arising out of ordinary negligence relating to the inherent risks of the Activities, my voluntary participation, or my use of the simulator area and related equipment.
- No Release of Non-Waivable Claims. This agreement does not release claims for gross negligence, reckless conduct, willful or wanton misconduct, intentional misconduct, fraud, or any duty or claim that cannot lawfully be waived.
- Safety Rules. I will follow all written and verbal rules and staff instructions, including ball type restrictions, swing-area control, age restrictions, equipment-use limits, footwear requirements, and no-participation rules for intoxicated or impaired persons. Fore-Play Golf may remove any participant acting unsafely.
- Health Representation. I certify that I am physically and mentally able to participate safely, and that I will stop immediately if I feel pain, dizziness, illness, or unsafe conditions.
- Damage Caused by Misuse. I am responsible for damage I cause through intentional misconduct, reckless behavior, unauthorized access, or knowing misuse of equipment or the venue.
- Emergency Care. In an emergency, I authorize Fore-Play Golf and venue staff to seek medical assistance for me. I understand I am responsible for any resulting medical costs.
- Photo / Video Release. Fore-Play Golf may photograph or record the Activities and use my image or likeness for advertising or social media unless I opt out in the field below.
- Minors. If the participant is under age 18, a parent or legal guardian must complete the minor section below. This form is intended to obtain informed consent, rules acknowledgment, emergency authorization, and related permissions. To the extent prohibited by New Jersey law, it does not purport to waive a minor participant's non-waivable claims.
- Governing Law and Venue. New Jersey law governs this form, and any lawsuit relating to it or the Activities shall be brought in a court of competent jurisdiction in New Jersey, unless applicable law requires otherwise.
- Severability. If any provision is held unenforceable, the remaining provisions shall remain in effect to the fullest extent allowed by law.
- Acknowledgment. I have read this form, understand it, and sign it voluntarily.
